Journal Copies Terms & Conditions

Introduction

These terms and conditions (“Terms”) are entered into by you (“You” or “Your”) and Taylor & Francis (a trading division of Informa UK Limited), a company registered in England and Wales with company number 01072954 whose registered office is at 5 Howick Place, London, SW1P 1WG (“T&F”).

T&F provides, at its sole discretion, select books and eBooks published by T&F on an “as available” basis to members of the media based on the title chosen (“Journalist Copy Service”; each book (whether hardcopy or electronic copy) a “Journalist Copy”).

T&F provides access to PDFs of books and physical copies of books to credentialed journalists subject to the Terms set forth herein. By completing and submitting the sign-up form, You hereby agree to these terms and conditions.

Credentials

Journalist Copies are only available to journalists, editors, freelancers and bloggers from recognised news or media outlets or that can show evidence of recent published articles (each a “Journalist”). T&F shall, in its sole discretion, determine whether You qualify as a Journalist and are thus eligible to gain access to a Journalist Copy. T&F may request additional information from You to verify whether You are a Journalist. T&F’s decision shall be final and no additional correspondence will be entered into.

Pre-publication copies

If You are in receipt of a Journalist Copy which is not yet published, You agree that this is to be kept confidential and personal to You. You shall not, as a principal obligation, disclose or forward any information found from the Copy or the Copy itself. You must notify T&F immediately of any unauthorised sharing or forwarding of the Journalist Copy or any sections of the Journalist Copy.

Journalist Copies are provided on an “as is” and “as available” basis and T&F accepts no liability for any loss or damage whatsoever sustained by You as a result of using or relying on the Copy.

All Journalist Copies are protected by international copyright laws, database rights, and other intellectual property rights. T&F, its affiliates or its licensees are the owners of these rights. All product, company and institutional names and logos which may be contained within the Journalist Copy are the trademarks, service marks or trading names of their respective owners. All rights not specifically granted to You under these Terms are reserved.

You are responsible for ensuring that Your IT system meets all relevant technical specifications necessary to access the Journalist Copy.

By agreeing to these terms, You agree that You shall: (i) not make any commercial use of the information in the Journalist Copy or use for the benefit of Yourself or any third party; (ii); and/or not copy, reproduce, summarise or reduce to writing any part of the Journalist Copy. You shall ensure that any news item You produce using the Journalist Copy, shall not be published before any agreed Embargo date specified. If You require any more information please email newsroom@taylorandfrancis.com.  T&F will treat any breach or alleged breach of this provision on embargo deadlines very seriously.

Indemnification & liability

You agree to indemnify and hold T&F harmless from any claim or demand, including reasonable legal fees made by any third party as a result of any infringement of T&F or any third party’s rights (including intellectual property rights) arising from Your use and/or misuse of the Journalist Copy and any breach of these Terms by You.

The Journalist Copy is provided “as is”, without any conditions, warranties or other terms of any kind. Nothing in these terms of use excludes or limits T&F’s liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, T&F exclude all conditions, warranties, representations or other terms which may apply to the Journalist Copy, whether express or implied.

T&F will not be liable to any You for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, the Journalist Copy; or
  • use of or reliance on any content in the Journalist Copy.

T&F will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

T&F will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the Embargo Area, or on any website linked to it.

To the extent permitted by law, if T&F is liable to You under these Terms for any reason, T&F’s liability shall be limited to £100.

Data protection

T&F may collect personal information from You, such as full name, country, job title, occupation, company information, e-mail address and telephone number. T&F only collect information of those who communicate with us via e-mail and have requested a Journalist Copy. If at any stage You want us to delete the account please contact T&F in the way described in our communications to You.

Any personal data (as defined in the Data Protection Act 1998) belonging to You which is shared with T&F shall be held and used by T&F in accordance with all applicable laws (including, without limitation to, the Data Protection Act 1998). Jurisdiction

You agree that the courts of England shall have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms or their formation. For these purposes each party irrevocably submits to the jurisdiction of the courts of England.

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of England.

T&F make no warranty or guarantee that the Journalist Copy complies with laws other than those of England.

You accept that these Terms represent the entire understanding between You and T&F concerning the Journalist Copy.
